Club Constitution
 

  1. NAME

The name of the club shall be the BRIDLINGTON CRICKET CLUB.

The club will be a constituent member of Bridlington Sports & Community Club.

  1. ADDRESS

The Club Premises shall be The Pavilion, Moorfield Car Park, Bridlington.

  1. STATUS

The club shall be a member of the Yorkshire Cricket Association (YCA) and the national governing body The England and Wales Cricket Board (ECB)

  1. OBJECTIVES

The objective of the club shall be: -

(a)     To play, promote and encourage the game of cricket.

(b)    To make provisions for playing facilities and to arrange matches as and when required.

(c)     To foster the game generally in Bridlington and the district.

(d)    To provide opportunities for young people to play cricket.

(e)     To provide opportunities for women to play cricket.

(f)      To develop links with local primary and secondary schools in the area.

(g)    To widen the opportunities for people from ethnic minorities to play cricket.

(h)     To provide at least one qualified coach per 15 members.

(i)       To ensure a duty of care to all members of the club by adopting & implementing the ECB ‘Safe Hands – Welfare of Young People in Cricket’ Policy & any future versions of the policy.

(j)       To ensure a duty care to all members of the club by adopting & implementing the ECB Equity Policy Statement & any future versions of the policy.

  1. MANAGEMENT

The Management of the club shall be in the hands of a General Committee, consisting of the President, the captains of each team, the Honorary Treasurer, the Honorary Secretary and six other elected members. The General Committee shall elect its own Chairman at the First Meeting after the Annual General Meeting, who shall remain in office for one year. Five shall form a quorum and the Chairman shall have casting vote.

  1. TRUSTEES

The property of the Club shall be vested in not more than four nor less than two Trustees who, as vacancies occur, shall be elected specially at the Annual General Meeting. They shall deal with the property of the Club as directed by resolution of the General Committee (of which entry in the Minute Book shall be conclusive evidence) and they shall be indemnified against risk and expense out of Club property.

  1. CLUB COLOURS

The colours of the Club shall be green and Gold

  1. CHILD WELFARE

The Club is to ensure a duty of care to all members of the Club by adopting and implementing ECB Safe Hands – Welfare of Young People in Cricket Policy and any future versions of the policy.

All members will be subject to the regulations of the constitution and by joining the Club, will be deemed to accept these regulations and the Club’s Code of Conduct.

The club has set up its own child protection policy which follows the Child Protection Policy of the EC and the ECBCA of which BCC coaches should become members prior to taking up any coaching of under 16’s

  1. MEMBERSHIP

Membership of the club shall be open to any person completing a membership form and by paying the relevant subscription as determined by the Annual General Meeting of the Club.

The club will operate an ‘Open Door’ towards membership irrespective of age, disability, race, ethnic origin, creed, colour, social status & sexual orientation and fully adopts the Sport England & ECB definition of sports equity.

(a)     Membership of the club will be the following categories: -

(b)    The President

(c)     Social Membership

(d)    Playing Membership (18 years of age and over)

(e)     Junior Membership (under 18 years of age)

(f)      Honorary Life Membership

(g)    Life Membership

A register of Members shall be kept by the Honorary General Secretary.

  1. SUBSCRIPTIONS

(a)     The annual subscription shall be determined each year at the AGM for the following classes of membership.

(b)    Social Membership

(c)     Playing Membership (18 years of age and over)

(d)    Junior Membership (under 16 years of age)

A playing member’s category and subscription shall be determined by his age on the 1st January in each subscription year.

Provided that the appropriate subscription is paid to the Bridlington Sports & Community Club, then at the discretion of the General Committee, those members who are able to play only in Sunday matches shall pay 50% of the annual subscription, and only in Thursday matches shall pay 33.33% of the annual subscription, with the exception of Junior Members.

  1. PRIVILEGES OF MEMBERSHIP

All playing and non playing members (excluding junior members) will be entitled to full voting rights, provided that their subscriptions has been paid for that year.

  1. CESSATION OF MEMBERSHIP

If any member shall fail to pay his subscription before the first day of June, the Honorary General Secretary shall send him a notice in writing to his address in the books of the club, calling him to pay the same within 28 days. If he shall fail to pay his subscription the Committee shall be entitled to terminate his membership without further notice.

No member shall be eligible for selection for any team whose subscription remains unpaid by the above date.

  1. MATCH LEVY

Playing Members may be called upon to pay a levy each match to help defray travelling, teas and other expenses. The amount of such levy to be determined by the Committee.

  1. ANNUAL GENERAL MEETING

The Annual General Meeting of the club shall be held as soon as possible after the 30th September each year to receive the following:

(1)     Honorary General Secretary’s Report

(2)     Honorary Treasurer’s Statement of Accounts

(3)     To determine the level of Subscriptions for the following year

(4)     To elect the following:

(a)     The President

(b)    Captain & Vice Captain of First, Second, Third, Sunday and Evening Elevens

(c)     Honorary General Secretary

(d)    Honorary Fixture Secretary

(e)     Honorary Treasurer

(f)      Honorary Auditor

(g)    Child Welfare Officer

(h)     Chairman of Selection Committee (who shall be a non playing member)

(i)       Members to fill vacancies on the General Committee (Note: two committee members shall retire in rotation each year, but shall be eligible for re-election. The two members elected to fill the vacancies shall each serve for three years)

(j)       Two representatives to serve on the Executive Committee of the Bridlington Sports & Community Club along with two substitutes who shall all serve for two years. At the end of their term of office, the representatives and substitutes may stand for re-election. (Note: The representatives to keep the club informed of decisions and discussions of the Executive Committee of the Sports & Community Club)

(5)     To transact any other business 

Twenty shall form a quorum and the Chairman shall have a casting vote.

Nominations of candidates for election (as above) shall be lodged with the Honorary General Secretary at least three days before the date of the Annual General Meeting

Voting shall be by ballot, and scrutineers shall be appointed by the Members present.

If sufficient nominations are not received for any office in accordance with the rule, then nominations may be made at the AGM.

  1. NOTICE OF ANNUAL GENERAL MEETING

At least 14 day’s notice of any AGM shall be given to Members. An audited Statement of Accounts to be included in the notice convening the AGM. 

  1. RECORD OF ATTENDANCES

A record shall be kept by the Honorary General Secretary of all attendances of the General Committee and Selection Committee, and this record shall be circulated with the notice convening the AGM.

  1. ALTERATION OF RULES

Any member desirous to move an amendment to the rules shall give due notice to the Honorary General Secretary at least 28 days before the AGM, and the Honorary General Secretary shall include such notice in the notice convening the meeting. No alteration to rules passed at the AGM shall become immediately binding.

  1. SPECIAL GENERAL MEETING

A Special General Meeting shall be held at any time on a written request signed by not less than twelve members, such requisition to state the reason for such a meeting, and only such matters as are the requisition shall be allowed to be discussed at the meeting. Twenty shall form a quorum and the Chairman shall have a casting vote.

  1. FORFEITURE OF SEAT ON COMMITTEE

Any member of the Committee (the President excepted) being absent from three consecutive meetings without reasonable excuse shall forfeit his seat and the Committee shall, at their next meeting, have the power to fill the vacancy.

The committee shall be empowered to fill any vacancy on the General Committee.

  1. DISCRETIONARY POWERS

The general Committee shall have the power to deal with any matter that arise in connection with the Club, and which is not provided for in the rules.

  1. DISCIPLINE & APPEALS

All complaints regarding the behaviour of members should be lodged in writing with the Secretary.

The General Committee shall appoint a disciplinary sub-committee who will meet to hear complaints within 7 days of a complaint being lodged. The General Committee (or its sub-committee) has the power to take appropriate disciplinary action, including the termination of membership.

The outcome of the disciplinary hearing shall be put in writing to the person who lodged the complaint and the member against whom the complaint was made within 7 days following the hearing.

There shall be a right of appeal to the General Committee following disciplinary action being given. The General Committee shall appoint an Appeals Committee drawn from the members not involved with the initial disciplinary hearing consider the appeal within 7 days of the Secretary receiving the appeal

  1. RULES BINDING ON MEMBERS

These rules shall be binding upon each Playing Member, and a copy will be posted in the Pavilion.

  1. DISSOLUTION

If at any General Meeting of the Club, a resolution be passed calling for the dissolution of the Club, the Secretary shall immediately convene a Special General Meeting of the Club to be held not less than one month thereafter to discuss and vote on the resolution.

If at that Special Meeting, the resolution is carried by at least two-thirds of the Full Voting Membership present at the meeting, the General Committee shall thereupon, or at such date as shall have been specified in the resolution, proceed to realise the assets of the Club and discharge all debts and liabilities of the Club.

After discharging all debts and liabilities of the Club, the remaining assets shall not be paid or distributed amongst the Full Members of the Club, but shall be given or transferred to the local County Board or any other voluntary cricket organisation in the area having objects similar to those of the Club.

  1. DECLARATION

Bridlington Cricket Club hereby adopts and accepts this constitution as a current operating guide regulating the actions of members
